[Treasury Department letterhead] ST. LOUIS, [Missouri] May 29th, 1917. AJB Busch-Sulzer Bros.-Diesel Engine Co., 2nd & Utah Sts., St. Louis, [Missouri]. Gentlemen:- Replying to your letter of the 5th inst. regarding your liability for munitions tax for the year 1916, you are advised that I am in receipt of the following communication from the Commissioner at Washington regarding the same: "This office is in receipt of your letter of the 15th instant, with which you enclose a letter from the Busch-Sulzer Bros.-Diesel Engine Company, in reply to a letter of this office addressed to you under date of April 18, 1917, relative to the preparation of the return of annual net profits of that corporation. In the letter, which you transmit, the company states that it understands its profits or losses are to be figured on the entire contracts from the date of such contracts to the completion of the same, and not from January 1, 1916 to the dates the contracts were completed. In reply, you are informed, and may so advise the corporation that its understanding is correct, and that since none of its contracts were complete on December 31, 1916, it will include in its return of annual net profits, Form 1089, the entire profits derived from the sale and disposition of its munitions for the year in which each separate contract is completed."
