March 29, 1918. Memorandum for the Judge Advocate General: The attached opinion, prepared by Major Wallace holds that the specific provisions of Sec. 1205 R. S. have been repealed by implication and that the following very explicit pronouncement is no longer operative:

[page 2] Turning to the new law governing appointments (as distinguished form details) in staff corps we find an utter silence on the subject matter of R.S. 1205 which conferred a valuable right upon appointees in staff corps in the most explicit terms of which language is capable. There is absolutely no overlapping or inconsistency between R.S. 1205 in its application to appointments in staff corps and the new Act, February 2, 1901, organizing the Judge Advocate General

Description | General John J. Pershing wrote General Enoch H. Crowder concerning the promotions of men at home versus the promotions of those abroad. The enclosed memorandum also addressed the law concerning the appointments and promotions of Staff officers, as well as their tenure and commissions. This document is part of a collection compiled by Enoch Herbert Crowder, the Edinburg, Grundy County, Missouri native who served as Judge Advocate General. Crowder devised the Selective Service Act in 1917 which drafted America's forces during World War I. |
