City of St. Louis. : TO WHOM IT MAY CONCERN: CHARLES CUMMINGS COLLINS, of the City of St. Louis, State of Missouri, lawyer, representing First Lieutenant Powhatan H. Clarke, whose present address as he is informed and believes is care of Headquarters Labor Bureau, Army Service Corps, A.P.O. 717, A.E.F., France, upon oath makes the following statement: The said First Lieutenant Powhatan H. Clarke is one of the two residuary beneficiaries under the will of Mary E. Boyce, Deceased, who died at the City of St. Louis, State of Missouri on or about the 21st day of December, 1917, and whose estate, as to the domiciliary administration thereof has been and is being administered in the Probate Court od said City of St. Louis, Number 48,829, and as to the ancillary administration thereof has been and is being administered in the Surrogate

[page 2] There have been many complications growing out of administration of the said Estate. The matters which have heretofore come up for settlement have been complex and complicated. Said First Lieutenant Powhatan H. Clarke is entitled to an undivided one-half beneficial interest in said Estate. Said one-half beneficial interest, unless the same shall be sacrificed, ought to be worth to him in excess of $150,000.00. He has been absent from the United States and in the service of the United States doe a period of more than one year, and there is grave danger of his suffering large financial loss, unless je soon returns to the United States and to the City of St. Louis, State of Missouri and to the City of New York, State of New York, within a reasonably short time, to the end that he may make the necessary arrangements to protect the security on the demand loans herein before mentioned and attend to the necessary details of the final settlement of said Estate. In the opinion of affiant, said First Lieutenant Powhatan H. Clarke will require at least six weeks time in which to do all that is necessary to be done for his proper protection as one of the two residuary beneficiaries of said Estate. Accordingly, affiant has no hesitation in making oath that in opinion of affiant after careful consideration, it is essential to the business interests of the said First Lieutenant Powhatan H. Clarke and to the protection of his property rights that the said First Lieutenant Powhatan H. Clarke shall return to the United States at the earliest possible moment. It is important for the proper protection of his rights; otherwise grave sacrifices and losses may result. This affidavit is made following cablegram transmitted by affiant December 23, 1918, addressed to Lieutenant Powhatan H. Clarke, Headquarters, Labor Bureau, Army Service Corps, A.P.O. 717, A.E.F., France, reading as follows:
